My Luxe Backyard runs on Shopify, and creating a customer account here is always optional, never required to browse or buy. This page explains, in plain language, what "your account" actually means on our store, how to delete your personal data or close your account, what we're required to keep and for how long, and the specific rights you hold under federal and state law no matter where in the Continental U.S. you live.

My Luxe Backyard is owned and operated by Navarro Living LLC. Our store runs on Shopify, and like most Shopify stores, you never need to create an account to browse our catalog or complete a purchase. Every order can be placed as a guest, using only the checkout information required to ship and bill the order.

If you do choose to create a customer account, that account stores your name, email address, saved shipping and billing addresses, and your order history, so you don't have to re-enter it next time. This page explains, specifically for our store and the categories we sell, how to delete that account, how to request deletion of your personal data whether or not you have an account, what we're legally required to retain and for how long, and the exact rights you hold under the Magnuson-Moss framework of state privacy law that now covers the large majority of the Continental United States.

We wrote this page around how our own Shopify store actually works, not as a copied template, and we update it as our data practices or the applicable laws change.

Definitions, In Plain Language

What these terms mean when we use them on this page

"Delete my account" and "delete my data" get used interchangeably in everyday conversation, but they aren't quite the same request. Here's exactly what each term means to us.

Account Termination

Closing your Shopify customer account so you can no longer log in with it. This removes your saved login and stops future use of that account, but doesn't by itself erase every underlying record.

Data Deletion

Permanently erasing the personal information we hold about you, such as your name, contact details, and browsing data, subject to what we're legally required to keep, such as tax and order records.

Verifiable Consumer Request

A request we can reasonably confirm was made by you, or by someone you've authorized, using information we already have on file, such as your order number and the email address on the order.

Retention Obligation

A legal requirement, such as tax law or fraud-prevention rules, that requires us to keep certain records for a set period even after you ask us to delete your data.

The Deletion Process

How to close your account or request data deletion, start to finish

Whether you have a customer account or checked out as a guest, the process to request deletion is the same, and it starts with contacting us directly rather than digging through account settings.

Email us your request

Email support@myluxebackyard.com with the subject line "Account Deletion" or "Data Deletion Request," from the email address associated with your account or order.

We verify it's really you

We'll confirm your identity using details you provide, such as a recent order number, billing zip code, or the name on the order, to protect against fraudulent deletion requests made in your name.

We process the request

We close the account and erase eligible personal data from our systems and, where applicable, instruct relevant service providers to do the same, within 45 calendar days of a verified request.

You get written confirmation

We'll email you confirming what was deleted, what (if anything) we're required to retain and why, and how long that retained information will be kept.

There's no in-account "delete my account" button in our current Shopify setup, which is exactly why we ask you to email us instead. This way, a real person reviews every request rather than an automated process making an irreversible decision. You're also welcome to call us at 609-354-7215 during business hours to start the process.
Full Transparency

Exactly what gets erased, and what we're required to keep

We'd rather tell you plainly what happens to each category of data than leave you guessing. Retention periods below reflect standard recordkeeping obligations for a U.S. e-commerce retailer; your specific timeline is confirmed in writing when we process your request.

Deleted Upon Request

Removed within 45 days

Your account login and profile, saved addresses, marketing preferences and newsletter subscription, browsing and cookie-linked data tied to your identity, and any support correspondence not required for a legal or warranty purpose.

Retained For Tax & Accounting

Typically 3–7 years

Order and invoice records, sales tax documentation, and payment transaction records are kept to satisfy IRS recordkeeping rules and state tax authority requirements, even after an account is closed. Your name and contact details may remain attached to these specific records only.

Retained For Fraud Prevention & Warranty

For as long as reasonably needed

If you have an open warranty claim, an active return, or a flagged fraud or chargeback investigation, records tied to that specific matter are kept until it's resolved, even if you've requested deletion of everything else.

If you have an active order in progress, deleting your account or data before that order ships and any return window closes may delay or prevent us from completing delivery, processing a warranty claim, or handling a return. We'll flag this for you before completing an active-order deletion request.
Legal Framework

The federal and state privacy law behind this policy

As of 2026, roughly twenty U.S. states have their own comprehensive consumer privacy law, and most grant you the right to request deletion of your personal data regardless of which state you live in. Because we ship to the Continental United States, we honor deletion requests consistently, no matter your state, but the table below shows the specific statutes that apply where you live.

California CCPA / CPRA Right to know, delete, correct, and opt out of sale or sharing of personal information; enforced by the California Privacy Protection Agency.
Virginia VCDPA Right to access, correct, delete, and obtain a portable copy of your personal data; right to opt out of targeted advertising.
Colorado CPA Right to access, correct, delete, and data portability, plus a required universal opt-out mechanism for targeted advertising.
Connecticut CTDPA Consumer rights to access, correct, delete, and port data, with added protections for minors' data.
Utah UCPA Right to access, delete, and obtain a copy of personal data, and to opt out of sale or targeted advertising.
Texas, Oregon, Florida, Montana, New Jersey & others State-Specific Acts Most other states with a comprehensive privacy law, including those newly effective in 2026, grant a similar core set of access, deletion, correction, and opt-out rights, generally modeled on the Virginia framework.

Our services are not for children

My Luxe Backyard is not directed at, and is not intended for use by, anyone under the age of 18. We do not knowingly collect personal data from children. If we learn that a customer account was created by or for someone under 18 without appropriate parental involvement, we will delete the associated account and personal data promptly upon verification.

If you believe a child's data was collected

A parent or guardian who believes their child has provided personal information to us can email support@myluxebackyard.com with the details, and we'll investigate and delete the relevant account or data as a priority matter.

Where Your Data Also Lives

The service providers we ask to delete data alongside us

Like any Shopify store, we rely on a small number of trusted service providers to run checkout, shipping, and email. When you request deletion, we forward that request to the providers below where applicable, in addition to deleting what's in our own systems.

Shopify (Platform)

Hosts our store, your account, and order records as our e-commerce platform provider, under Shopify's own data processing terms.

Payment Processors

Handle your payment card or digital wallet details directly; we never store full card numbers ourselves. Refund and chargeback records may be retained per card network rules.

Shipping & Fulfillment Partners

Receive your shipping address and contact details solely to deliver your order, and retain them only as long as needed for delivery, tracking, and claims.

Email & Marketing Tools

Store your email address if you subscribed to our newsletter. Unsubscribing or requesting deletion removes you from these tools as well.
