What This Policy Does Not Cover

Third-party websites we link to, and any information you share directly with a manufacturer's own warranty service, are governed by that party's own policy, not this one.

Information We Collect

Exactly what we gather, and where it comes from

We only collect what we need to run this store, ship large outdoor items like pergolas and saunas safely to your address, and keep you informed if you ask us to. Here is a complete breakdown.

Information you give us directly

Your email address and, if provided, phone number, when you opt in to our newsletter, an on-site discount offer, or SMS updates.

Information collected automatically

Device & Browser Data

IP address, browser type, device type, operating system, and general location inferred from your IP address (city or region level, not precise GPS).

Browsing Behavior

Pages viewed, products browsed, items added to cart, time spent on the Website, and the site or ad that referred you here.

Cookies & Similar Technologies

Small data files placed by our Shopify storefront and by analytics and advertising partners, described in detail in the section below.

Transaction & Fraud-Signal Data

Order history and checkout patterns used by our payment processor to screen for fraudulent or unauthorized transactions.

Information from other sources

Shopify & Payment Processors

Confirmation that a payment was authorized or declined, and limited billing details needed to process a refund or dispute.

Shipping Carriers

Delivery status and tracking updates for the freight and parcel carriers we use to ship pergolas, gazebos, saunas, and other large items.

Information we intentionally do not collect

We do not ask for or store your full payment card number, Social Security number, government ID, or precise real-time GPS location. We do not knowingly collect health, biometric, or genetic information, and browsing our sauna or cold plunge collections does not create or infer any health-related profile about you.

How We Use Your Information

Cookies & Tracking Technologies

How our Website recognizes returning visitors

Cookies are small text files stored on your device. Our Shopify storefront and the tools we use place the following categories of cookies and similar technologies.

Strictly Necessary Cookies

Required for the cart, checkout, account login, and basic security to function. These cannot be switched off without breaking core Website features.

Analytics Cookies

Help us understand traffic patterns and product interest across our pergola, gazebo, sauna, and fire pit collections, using aggregated, non-identifying reports.

Marketing & Advertising Cookies

Used to measure the performance of our advertising and to show relevant ads for products you have viewed, on this Website and elsewhere.

Preference Cookies

Remember choices such as items left in your cart or a discount code you have already unlocked, so you don't have to re-enter them.

You can control or delete cookies through your browser settings at any time, and most browsers let you block cookies from specific sites. Blocking strictly necessary cookies may prevent checkout from working correctly. For advertising and analytics cookies specifically, see "Your Opt-Out Rights" below.

How We Share Your Information

We do not sell your data. Here is who we work with instead

Navarro Living LLC does not sell your personal information to third parties for money. To run this store, however, we do share limited information with the service providers below, each bound by its own confidentiality and data-protection obligations.

Shopify (Platform Host)

Hosts our storefront, checkout, and order database. Shopify processes data on our behalf and maintains its own security and privacy commitments.

Payment Processors

Shopify Payments and other supported processors handle your card or wallet details directly to authorize and process payment. We never see or store your full card number.

Shipping & Freight Carriers

Your name, delivery address, and phone number are shared with the parcel and freight carriers needed to deliver items like pergolas, gazebos, and saunas to your door.

Email & SMS Marketing Platform

If you opt in, your email address or phone number is shared with our marketing platform solely to send the newsletters, offers, or texts you agreed to receive.

Analytics & Advertising Partners

Tools such as website analytics and advertising pixels receive device and browsing data to help us measure traffic and ad performance across our product categories.

Legal & Safety Disclosures

We may disclose information when required by law, to defend our legal rights, or to investigate fraud, security incidents, or violations of our Terms of Service.

A note on the word "sale" or "share" under state privacy law

Some state privacy laws define "sale" or "sharing" broadly enough to include letting advertising cookies collect browsing data for interest-based ads, even where no money changes hands. To the extent our use of analytics and advertising cookies falls within that broader definition, we honor your right to opt out, as described in the next section.

Your Opt-Out Rights

Turning off targeted advertising and data sharing

You are never required to accept marketing cookies or targeted advertising to shop with us. Checkout, order tracking, and customer support all work without them.

Submit Our Opt-Out Form

Use our Privacy Opt-Out Request Form to ask us to stop sharing your information with analytics and advertising partners.

Global Privacy Control

Where technically supported by your browser and legally recognized in your state, we honor the Global Privacy Control signal as a valid opt-out request.

Browser Cookie Settings

Block or delete cookies at any time through your browser's privacy settings, which will limit tracking across all sites, not only ours.

Unsubscribe Links

Every marketing email includes an unsubscribe link, and every marketing text includes reply instructions to stop messages instantly.

Your Privacy Rights Under State Law

Rights that apply depending on where you live

We ship only within the Continental United States, and a growing number of U.S. states now give their residents specific rights over personal information. We apply the following rights to any customer covered by one of these laws, and as a matter of practice, we extend the core rights below to customers nationwide.

California residents (CCPA, as amended by the CPRA)

Right to Know

Request the categories and specific pieces of personal information we have collected about you in the past 12 months.

Right to Delete

Request deletion of personal information we hold about you, subject to exceptions such as completing an order or meeting a legal obligation.

Right to Correct

Ask us to correct inaccurate personal information, such as an outdated shipping address or phone number.

Right to Opt Out of Sale or Sharing

Direct us to stop any sale or sharing of your information, including for cross-context behavioral advertising, at any time.

Right to Limit Sensitive Information Use

As noted above, we do not knowingly collect sensitive personal information beyond what is standard for order processing.

Right to Non-Discrimination

We will never charge you a different price or provide a lower level of service because you exercised a privacy right.

Other state privacy laws

Residents of states with comprehensive privacy laws currently in effect, including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Minnesota, Maryland, Rhode Island, Kentucky, Indiana, and Tennessee, generally have the right to know, access, correct, delete, and opt out of the sale, sharing, or targeted advertising use of their personal information, and the right to appeal a denied request. We apply these same rights when you contact us, regardless of exactly which state law technically governs your request.

Because Navarro Living LLC is registered in New Jersey, the New Jersey Data Privacy Act also applies directly to how we handle personal information tied to our business operations, alongside whichever law applies based on your own state of residence.

Exercising Your Rights

How a request actually gets handled

1. Submit Your Request

Email support@myluxebackyard.com or complete our Privacy Opt-Out Request Form, telling us which right you'd like to exercise.

2. We Verify It's You

We may ask you to confirm your name, email, and order details to verify your identity before acting on a data or deletion request.

3. We Respond

We aim to respond within 45 days, as required under most state laws, with a possible 45-day extension for complex requests, and we'll tell you if that applies.

You may also designate an authorized agent to submit a request on your behalf, and you may appeal a denied request by replying to our response email with "Appeal" in the subject line. We do not charge a fee for verified privacy requests.

Marketing Communications

Emails, texts, and how to stop them

Email Marketing

We send newsletters and offers, such as our first-order discount, only to addresses that opted in. Every email complies with the CAN-SPAM Act and includes a working unsubscribe link.

SMS Marketing

If you provide your phone number and opt in to texts, we follow the Telephone Consumer Protection Act. Reply STOP at any time to end messages instantly.

Order & Shipping Notifications

Transactional messages, such as order confirmations and shipping updates, are not marketing and will be sent regardless of your marketing preferences.

Changing Your Mind

You can unsubscribe from email, reply STOP to text messages, or email support@myluxebackyard.com to update your preferences at any time.

Retention, Security & Children's Privacy

How long we keep data, and how we protect it

Data retention

We keep order and transaction records for as long as needed to satisfy tax, accounting, and warranty obligations, generally for the period required under New Jersey and federal recordkeeping law. Marketing contact information is kept until you unsubscribe or request deletion. Account and browsing data no longer needed for these purposes is deleted or anonymized on a routine basis.

Data security

Our storefront, checkout, and payment processing run on Shopify's PCI DSS-compliant infrastructure, with encryption in transit for checkout and account pages. Internally, access to customer data is limited to team members who need it to do their job. No online system can be guaranteed 100% secure, and we encourage you to use a strong, unique password on your account.

Children's privacy

This Website is not directed to children, and as stated in our Terms of Service, you must be at least 18 years old to place an order. We do not knowingly collect personal information from children under 13, in accordance with the Children's Online Privacy Protection Act (COPPA). If we learn we have inadvertently collected a child's information, we will delete it promptly.
