My Luxe Backyard sells pergolas, gazebos, patio furniture, fire pits, saunas, and cold plunges, products that involve open flame, electrical current, extreme temperature, and structural weight by design. This page explains, product by product, the risks inherent in normal use, the safe-use guidance we expect you to follow, and the legal limits on our liability when a product is used as intended versus misused, modified, or installed outside the manufacturer's instructions.
A retailer's honest account of risk, use, and responsibility
My Luxe Backyard is owned and operated by Navarro Living LLC. We are a retailer, not the manufacturer of the pergolas, gazebos, patio furniture, fire pits, saunas, and cold plunges we sell. Several of these product categories involve open flame, mains-voltage electrical components, extreme heat or cold, and significant structural weight, so we believe you deserve a clear, specific account of what those risks actually are and how to use each product safely, rather than a single generic disclaimer buried in our Terms of Service.
This page works alongside, not instead of, our general Terms of Service. Section 10 and Section 11 of our Terms set out our broad "as is" disclaimers and limitation of liability for the Website and Services. This page applies those same principles specifically to the physical products you buy from us, with the category detail and safety context that general terms of service language does not provide.
Nothing on this page is intended to remove a right that federal law, your state's product liability law, or your state's consumer protection law does not allow us to remove. Where state law limits what a seller can disclaim, your statutory rights control over anything written here.
What the words in this policy actually mean
Liability terminology gets used loosely. Here's exactly what each term means when we use it on this page.
Inherent Risk
A risk that exists in a product's normal, intended use and cannot be fully engineered away, such as the heat of a fire pit flame or a sauna heater, or the cold-water shock of a cold plunge. Inherent risks are disclosed, not hidden.
Intended Use
Using a product for its stated purpose, following the manufacturer's instructions, weight and capacity limits, and any included safety or health warnings. Our liability framework is built around products used as intended.
Misuse or Modification
Using a product outside its intended purpose, beyond its stated weight or capacity, with altered or third-party components not approved by the manufacturer, or without following required electrical, gas, or anchoring instructions.
Limitation of Liability
A contractual term that caps or excludes certain categories of damages, such as indirect or consequential loss. It does not, and legally cannot, eliminate liability for gross negligence, willful misconduct, or, in many states, personal injury caused by a defective product.
What to know about each category before you buy or use it
Every category we sell carries its own use considerations. This is a transparent, category-specific summary, not a substitute for the manufacturer's full safety literature, which is included with every order and should always be read before first use.
Pergolas & Louvered Roofs
Structural & wind riskAn improperly anchored or assembled pergola can shift, lean, or collapse in wind, putting people and property at risk. Always anchor exactly to the manufacturer's instructions and stated wind rating, and retract or close motorized canopies ahead of storms.
Gazebos
Wind & snow load riskHardtop gazebos are rated for specific wind and, where stated, snow loads. Exceeding those ratings, or failing to anchor the frame, can cause structural failure. Clear heavy snow promptly and never exceed the load rating on the product page.
Patio Furniture Sets
Weight limit & tip-over riskEvery piece carries a maximum weight or occupancy rating listed on the product page. Standing on tables, exceeding seat weight limits, or placing furniture on uneven ground increases tip-over and structural failure risk.
Fire Pits
Open flame, burn & fire riskFire pits involve open flame and surfaces that reach burn-causing temperatures. Maintain the manufacturer's stated clearance from structures, plants, and combustibles, never use indoors or under cover, supervise constantly, and never leave a lit unit unattended around children or pets.
Saunas
Heat, electrical & health riskSauna use involves sustained high heat and an electrical heater that must be installed exactly per the manufacturer's voltage and GFCI requirements. Limit session length, stay hydrated, and consult a physician before use if you are pregnant or have a heart condition, low or high blood pressure, or any condition affected by heat exposure.
Cold Plunges
Cold shock, electrical & health riskCold immersion can trigger cold shock response, elevated heart rate, and breathing changes, and the chiller is an electrical appliance operating near water. Never use alone, limit session length, and consult a physician first if you have a cardiovascular condition, are pregnant, or have any condition affected by sudden cold exposure.
Before you use a sauna
Do not use if pregnant, under the influence of alcohol or drugs, or immediately after strenuous exercise. Consult a physician first if you have heart disease, high or low blood pressure, diabetes, or any condition affected by heat. Limit sessions as the manufacturer recommends, exit immediately if you feel dizzy, nauseous, or unwell, and never use alone.
Before you use a cold plunge
Consult a physician first if you have a cardiovascular condition, are pregnant, or have a condition affected by sudden cold exposure. Enter gradually, never alone, and limit immersion time as the manufacturer recommends. Exit immediately if you experience chest pain, numbness, or difficulty breathing.

Where our responsibility applies, and where it's limited
Defects in materials or workmanship
Covered under the applicable manufacturer's warranty and our 30-Day Return & Refund Policy when the product was used as intended.
Injury or damage from intended use
Where a product is defective and used as intended, we work with you and the manufacturer toward a fair resolution rather than disclaiming responsibility outright.
Misuse, modification, or non-compliant install
Liability for injury or damage arising from misuse, unauthorized modification, exceeding weight or capacity limits, or non-code-compliant electrical or gas installation is limited to the fullest extent state law allows.
Indirect or consequential loss
As stated in our Terms of Service, we are not liable for indirect, incidental, or consequential damages arising from product use, except where such a limitation is not permitted by law.
What this policy does not do
This page does not disclaim liability for our gross negligence, fraud, or willful misconduct, and it does not disclaim liability for personal injury caused by a genuinely defective product in any state where such a disclaimer would be unenforceable. It is a description of how we approach risk and responsibility, not an attempt to avoid responsibility for harm we actually caused.
This doesn't reduce your other rights
Nothing here reduces your rights under our Warranty & Warranty Disclaimer Policy, our Return & Refund Policy, our Terms of Service, or any federal or state consumer protection or product liability law that applies to your purchase.
